Sure, but what matters is the provenance of the rights applied by Elite and how far they extend. There's copyright, there's intellectual property rights and there's more nebulous stuff like registered trademarks. Commentators tend to mix and match these things up. It's worth pointing out that a two dimensional array is just a one dimensional array. You just index the row by X columns.
