No files for "Available" games

Post by Pobulous »

Manic Miner and Jet Set Willy are both listed as Available (as opposed to Distribution Denied) and yet both have no links to download the files.

@Pobulous,

I'm not in front of my computer right now, but I vaguely recall something linked to Steve Wilcox and the rights to both games. So to be on the safe side I probably took the decision to hide the downloads. Let me check.

I know it's not perfect, but as ZXDB is used on many sites, and the available flag is in the database it does mean that if I decide to hide a title, then that flag may be misleading. This impacts a very small number of titles though. You are quite right to query it.

Yeah, I thought it might be something to do with Steve Wilcox, and Matt Smith not being the rights holder, but I couldn't find any posts that mentioned they were actually denied.

I didn't know about this.
Sad days came, when Manic Miner and JSW were denied titles...

@PeterJ

Hmmm, is there any exact evidence that mr. Wilcox is owner of MM & JSW games ?
I found this discussion, from which it can be concluded that there are separate rights to the games, and to the MM sprite&design.
It is also reported, that Mathew Smith has stated that he has the rights to MM, but not to JSW.
Total confusion...

I just saw, that the original JSW is disabled for download on SC, but JSW II and bunch of JSW clones, are not.
How is that ?
If copyright is violated, then it applies to all titles, where Miner Willy appears and it should be corrected immediately.
Otherwise, we will never be safe from a potential million-dollar lawsuit by Mr. Wilcox ?

If you agree to cover my legal fees if I get contacted, then of course.

Only information I have is here:

https://www.elite-systems.co.uk/elite/h ... p?show=100

I tend to be cautious @Pegaz especially where Elite are concerned.

I've disabled downloads for the original MM and JSW (and now JSW 2). Of course if the copyright holder (who ever that may be) contacts me we will comply with any reasonable requests (as we always do).

My understanding is that the trademark is more about stopping people making money from items with the Manic Miner sprite. For example mugs, t-shirts etc.
